We handle all matters necessary to establish and execute an effective estate plan to assure the orderly distribution of your assets upon your death to your beneficiaries. Our aim is to assist you in achieving the most effective disposition of your assets, so that the needs of the members of your family will be taken care of after your death. Needless to say, minimizing estate, gift and income taxes is the focus of much of estate planning, as long as it does not interfere with the protection of your family.

We will discuss the importance of a will, and trusts, and various ways to hold property that will avoid having to probate the estate.

Many of our estate plans involve the establishment of a revocable living trust which avoids probate. These trusts provide for the disposition of your estate to your family members and also provide effective provisions to maximize protection against estate taxes.

Our trust and estate planning services include the preparation of a revocable living trust, pour-over wills, durable powers of attorney for health care decisions, durable powers of attorney, patient privacy directives and natural death act statements.

We also cover many other estate planning devices such as charitable remainder trusts, life insurance trusts, buy-sell agreements, prenuptial and postnuptial agreements.

We will prepare all documents required to implement your estate plan in a professional and courtesy manner and at a reasonable expense.

In the event that a probate or trust administration is necessary after the death of a loved one, we assist in helping you through the probate administration and/or trust administration. In order to handle a probate of a will it is necessary to have a personal representative appointed. We assist in preparing all of the documentation to have the personal representative appointed as either an executor or administrator. We also assist in organizing the assets and obtaining the values for them as of the date of death. We will also coordinate the liquidation of real property and personal property and the preparation of an accounting of the income and expenses. Unless a federal estate tax return is needed, we can generally close out a probate estate between six months to one year.

With respect to the administration of trusts, we assist the Trustee in sending out the appropriate notification to beneficiaries, and also assist in organizing the trust assets and obtaining values for them, paying creditors and provide for the ultimate distribution of the assets to the beneficiaries pursuant to the terms of the trust.

We represent individuals who seek legal protection for family members who lack the capacity to manage their own affairs, whether due to age, injury or other issues. Guardianships are used for individuals under eighteen years of age and Conservatorships are required for individuals eighteen years and older.

The Guardianship and Conservatorship process includes the filing of a petition for appointment and numerous supporting documents. We assist the client with the preparation of those documents and after the appointment we help in obtaining an inventory and appraisal of the assets. We also appear at the 100 Day Review Hearing and also coordinate the preparation of the accounting at the end of the first year. The first year of the Conservatorship and Guardianship are the most time consuming years. After that, the Court generally will require yearly status reports and/or accountings for the Guardianships and Conservatorships on a bi-annual basis.

We know these proceedings can be very difficult for the client due to his or her concerns over the loved one involved. We try to be compassionate and alleviate the stressful undertaking from the client.

We also work with private fiduciaries to take care of individuals who live in our community when the client lives elsewhere or is unable to care for the relative.
